OFF THE PATH FZE

TERMS & CONDITIONS – INTERNATIONAL GROUP TRAVEL
These Terms & Conditions apply to all international trips organised by Off The Path FZE (“Off The Path” or “the Company”). By confirming a booking, the participant agrees to the terms outlined below.
1. Booking & Deposit
A booking is confirmed upon receipt of a 30% deposit of the total trip price.
The remaining balance is due no later than 60 days prior to departure, unless otherwise stated in writing.
Failure to pay the remaining balance by the due date may result in cancellation of participation, with applicable cancellation charges applied.
2. Cancellation by Participant
All cancellations must be submitted in writing.
The following cancellation terms apply:

90 days or more before departure:
The deposit is converted into travel credit valid for 12 months from the original departure date. -
60–89 days before departure:
50% of the total trip price will be charged as a cancellation fee. -
Less than 60 days before departure:
100% of the total trip price will be charged.
If cancellation occurs before full payment has been made, the participant remains liable for any applicable cancellation charges.
No refunds will be granted for:

Failure to obtain visas or travel documents
-
Personal reasons
-
Late arrival or early departure
-
Failure to comply with entry requirements
3. Travel Credit Policy
Travel credits:

Are valid for 12 months from the original departure date
-
May be applied toward any available Off The Path trip
-
Are non-transferable unless approved in writing
Credits are subject to availability and price differences may apply.
4. Minimum Group Size
Trips are based on a minimum number of participants (typically 4).
If the minimum number is not reached, Off The Path reserves the right to:

Cancel the trip and issue a full refund of payments made; or
-
Offer the trip at a revised price reflecting the smaller group size; or
-
Offer transfer of funds to another departure.
Participants will be informed in reasonable time prior to departure.

5. Changes to Itinerary
Due to the nature of remote and adventure travel, itineraries may be adjusted for operational, safety, weather, political, or logistical reasons.
Off The Path reserves the right to substitute accommodations, transport, or activities of comparable standard if necessary.
Such changes do not entitle participants to a refund.
6. Pricing & Domestic Flights
Trip prices are based on supplier rates, currency exchange, fuel costs, and government taxes at the time of publication.
Where domestic flights or internal transport are included, these are subject to local airline policies and availability.
If cost increases occur prior to final payment due to currency fluctuations, fuel surcharges, government taxes, or airline adjustments, Off The Path reserves the right to adjust pricing accordingly.
Once issued, domestic flight tickets may be non-refundable and subject to airline rules.
7. Cancellation by Off The Path
Off The Path reserves the right to cancel a trip due to:

Insufficient participants
-
Safety concerns
-
Political instability
-
Operational constraints
-
Force majeure
In such cases, participants may choose between:
-
A full refund of payments made to Off The Path; or
-
Transfer of funds to another trip.
Off The Path is not responsible for international flight costs, visa fees, insurance, or other personal expenses.
8. Force Majeure
Off The Path is not liable for failure to perform obligations where such failure results from events beyond its reasonable control, including but not limited to:

Natural disasters
-
Government actions
-
War or civil unrest
-
Pandemics
-
Airline cancellations
-
Border closures
In such cases, refunds will depend on recoverable funds from suppliers.
9. Travel Insurance
Comprehensive travel insurance covering medical treatment, emergency evacuation, repatriation, and trip interruption is mandatory.
Participants may be asked to provide proof of insurance prior to departure.
10. Responsibility
Off The Path organises and assembles travel services in collaboration with independent licensed suppliers.
Participant responsibilities, risk acknowledgments, and liability limitations are governed by the signed Participant Agreement.
